Job Description

The Chief Compliance Officer is responsible for ensuring that regulatory compliance and OPWDD/New York State Justice Center policy guidelines are appropriately maintained across the agency through the performance of audits, development of plans of correction, and compliance training.The Chief Compliance Officer demonstrates knowledge of and commitment to Opengate, Inc.'s mission, vision, and values. In addition, this position actively participates in assigned projects and committees to enhance the agency's efforts to ensure ongoing excellence and quality service delivery for both the individuals Opengate serves and the staff who support them.

Essential Job Functions:
  • Development, oversight and monitoring of Opengate's Corporate Compliance Plan.
  • Identify and report any substantial compliance risks to the CEO, and as appropriate to the Board of Directors.
  • Provide assistance and training across departments.
  • Development and maintenance of Policies and Procedures, ensuring compliance with state and federal regulations.
  • Perform internal audits and monitor activities as directed
  • Prepare written reports of audit findings that include corresponding corrective action plan.
  • Serve as Chairperson of the Corporate Compliance Committee.
  • Provide oversight and guidance in matters of Incident Management.
  • Facilitates that the interests and goals of Opengate are in compliance with laws and regulations.
  • Facilitates compliance with Medicaid billing and payment Compliance.
  • Facilitates Part 624, Part 625, and Part 633 OPWDD Regulations Compliance.
  • Facilitates HCBS Waiver regulations Compliance.
  • Facilitates OMIG Compliance.
  • Oversight of IT Security Compliance.
  • Investigate and act on matters related to compliance, including:
  • Undisclosed/improperly managed conflicts of Interest
  • Alleged fraud/falsified claims or statements
  • Forgery
  • Documentation issues
  • Billing questions and related requirements to bill
  • Wasteful practices or substandard care
  • Misappropriation of agency funds or other resources (Theft, embezzlement etc.)
  • Acceptance of prohibited kickbacks/ gifts
  • Prohibited retaliation/intimidation
  • Destruction of records prior to the required retention period
  • Concerns about confidentiality of proprietary information/ intellectual property
  • Overpayments/self-disclosures
  • Excluded parties
  • Coordinate and facilitate health record systems, including oversight of EHR and HIPAA Compliance including:
  • Facilitate and coordinate the use of electronic records including implementing systems, auditing system use and documenting any breaches.
  • Consent/authorization for PHI disclosures
  • Access to PHI and complaints related to right of access requests to PHI Improper disposal of PHI and complaints related to violations of using/disclosing PHI for reasons not required or allowed by law PHI disposal
  • Reportable breaches
  • Issues related to provision of Notice of Privacy Practices
  • Mitigation measures (clean desk practices, role based access, etc.)
  • Investigation of violations related to the security of electronic PHI
  • Access management (auditing user access and activity reports for suspicious activity)
  • Information blocking
  • Lost/stolen devices
  • Disaster recovery and data backup
  • Updates and disseminates compliance posters and other relevant documentation as needed or upon change.
  • Ensure the Board of Directors functions within parameters consistent with NonProfit Revitalization Act.
  • Follows federal, state and local governmental regulatory guidelines pertaining to a safe, healthy and clean work environment, reporting health and safety concerns to the supervisor.
  • Other duties as assigned by the CEO
Qualifications:
  • Bachelor's and/or master's degree in health, Human Services, Psychology, Management, or closely related field.
  • Five years' experience working with I/DD population.
  • Knowledge of state and federal regulations as they pertain to Health Care Providers and operators of OPWDD services and the New York State Justice Center.
  • On-going professional development and membership in professional organizations.
Physical Requirements:
  • Ability to work in a professional office environment for extended periods of time, routinely using standard office equipment.
  • Ability to lift, push and pull up to 50 pounds, as well as bend, kneel and crouch as needed

Salary -$110,000 to $120,000. Compensation will be commensurate with job qualifications and work experience.
